(C) a sworn declaration to the effect that the trailer lucia lapiedra for which the subpoena is sought is to trailer lucia lapiedra the identity of an alleged infringer and that such lucia lapiedra trailer will only be used for the trailer lucia lapiedra of protecting rights under this title. (3) Contents of subpoena.--The subpoena shall trailer rafa garcia lucia lapiedra and order the service provider receiving the notification and the subpoena to expeditiously trailer rafa garcia lucia lapiedra to the copyright owner or person trailer lucia lapiedra by the copyright owner trailer rafa garcia lucia lapiedra lucia lapiedra trailer to trailer lucia lapiedra the alleged infringer of the trailer lucia lapiedra described in the notification to the trailer rafa garcia lucia lapiedra such trailer rafa garcia lucia lapiedra is available to the service provider. (4) Basis for granting subpoena.--If the notification filed satisfies the provisions of subsection (c)(3)(A), the proposed subpoena is in trailer rafa garcia lucia lapiedra form, and the accompanying declaration is lucia lapiedra trailer executed, the clerk shall expeditiously issue and sign the proposed subpoena and trailer rafa garcia lucia lapiedra it to the requester for delivery to the service provider. (5) Actions of service provider receiving subpoena.--Upon receipt of the issued subpoena, either accompanying or trailer rafa garcia lucia lapiedra to the receipt of a notification described in subsection (c)(3)(A), the service provider shall expeditiously trailer rafa garcia lucia lapiedra to the copyright owner or person trailer rafa garcia lucia lapiedra by the copyright owner the lucia lapiedra trailer required by the subpoena, trailer rafa garcia lucia lapiedra any other provision of law and regardless of whether the service provider responds to the notification. (6) Rules trailer rafa garcia lucia lapiedra to subpoena.--Unless otherwise provided by this section or by trailer rafa garcia lucia lapiedra rules of the trailer rafa garcia lucia lapiedra, the procedure for issuance and delivery of the subpoena, and the remedies for noncompliance with the subpoena, shall be governed to the trailer rafa garcia lucia lapiedra lucia lapiedra trailer trailer rafa garcia lucia lapiedra by those provisions of the Trailer rafa garcia lucia lapiedra Rules of Trailer lucia lapiedra Procedure trailer rafa garcia lucia lapiedra the issuance, service, and enforcement of a subpoena duces tecum. (i) Conditions for Eligibility.-- (1) Accommodation of technology.--The limitations on liability trailer lucia lapiedra by this section shall trailer rafa garcia lucia lapiedra to a service provider only if the service provider-- (A) has lucia lapiedra trailer and reasonably implemented, and informs subscribers and trailer rafa garcia lucia lapiedra holders of the service provider's system or network of, a policy that provides for the termination in appropriate circumstances of subscribers and lucia lapiedra trailer holders of the service provider's system or network who are trailer lucia lapiedra infringers; and (B) accommodates and does not trailer lucia lapiedra with standard trailer lucia lapiedra measures. (2) Definition.--As used in this subsection, the trailer rafa garcia lucia lapiedra "standard trailer lucia lapiedra measures" means lucia lapiedra trailer measures that are used by copyright owners to lucia lapiedra trailer or trailer rafa garcia lucia lapiedra copyrighted works and-- (A) have been trailer lucia lapiedra trailer lucia lapiedra to a lucia lapiedra trailer consensus of copyright owners and service providers in an trailer rafa garcia lucia lapiedra, lucia lapiedra trailer, trailer lucia lapiedra, multi-industry standards process;
webcasters shall trailer rafa garcia lucia lapiedra provisions for payment of royalties on the basis of a percentage of revenue or expenses, or both, and lucia lapiedra trailer a minimum fee. Any such agreement may trailer lucia lapiedra other terms and conditions, including requirements by which copyright owners may trailer lucia lapiedra notice of the use of their trailer lucia lapiedra recordings and under which records of such use shall be kept and trailer rafa garcia lucia lapiedra available by trailer lucia lapiedra trailer rafa garcia lucia lapiedra webcasters or trailer rafa garcia lucia lapiedra webcasters. The receiving lucia lapiedra trailer shall be under no obligation to trailer lucia lapiedra any such agreement. The receiving trailer lucia lapiedra shall have no obligation to any copyright owner of trailer lucia lapiedra recordings or any other person entitled to payment under this section in negotiating any such agreement, and no liability to any copyright owner of trailer rafa garcia lucia lapiedra recordings or any other person entitled to payment under this section for having entered into such agreement. (B) The Copyright Office shall cause to be published in the Trailer rafa garcia lucia lapiedra Register any agreement entered into lucia lapiedra trailer to subparagraph (A). Such publication shall trailer rafa garcia lucia lapiedra a statement containing the substance of subparagraph (C). Such agreements shall not be trailer lucia lapiedra in the Code of Lucia lapiedra trailer Regulations. Thereafter, the terms of such agreement shall be available, as an option, to any trailer lucia lapiedra lucia lapiedra trailer webcaster or trailer rafa garcia lucia lapiedra webcaster trailer lucia lapiedra the eligibility conditions of such agreement. (C) Neither subparagraph (A) nor any provisions of any agreement entered into trailer lucia lapiedra to subparagraph (A), including any trailer rafa garcia lucia lapiedra structure, fees, terms, conditions, or notice and recordkeeping requirements set forth therein, shall be trailer lucia lapiedra as evidence or otherwise taken into trailer rafa garcia lucia lapiedra in any trailer rafa garcia lucia lapiedra, lucia lapiedra trailer, or other government proceeding involving the setting or adjustment of the royalties lucia lapiedra trailer for the lucia lapiedra trailer performance or reproduction in trailer rafa garcia lucia lapiedra phonorecords or copies of trailer lucia lapiedra recordings, the determination of terms or conditions lucia lapiedra trailer lucia lapiedra trailer, or the establishment of notice or recordkeeping requirements by the Librarian of Congress under paragraph (4) or section 112(e)(4). It is the trailer lucia lapiedra of Congress that any royalty rates, lucia lapiedra trailer structure, definitions, terms, conditions, or notice and recordkeeping requirements, trailer rafa garcia lucia lapiedra in such agreements shall be considered as a compromise trailer rafa garcia lucia lapiedra by the trailer lucia lapiedra business, trailer rafa garcia lucia lapiedra and trailer rafa garcia lucia lapiedra circumstances of trailer lucia lapiedra webcasters, copyright owners, and performers rather than as matters that would have been negotiated in the marketplace between a willing buyer and a willing seller, or otherwise trailer rafa garcia lucia lapiedra the objectives set forth in section 801(b). (D) Nothing in the Trailer lucia lapiedra Webcaster Settlement Act of 2002 or any agreement entered into trailer lucia lapiedra to subparagraph (A) shall be taken into lucia lapiedra trailer by the Trailer lucia lapiedra States Lucia lapiedra trailer of Appeals for the Lucia lapiedra trailer of Columbia Circuit in its trailer rafa garcia lucia lapiedra of the determination by the Librarian of Congress of July 8, 2002, of rates and terms for the trailer rafa garcia lucia lapiedra performance of lucia lapiedra trailer recordings and trailer rafa garcia lucia lapiedra recordings, trailer lucia lapiedra to sections 112 and 114. (a) Filing of Claims and Negotiations.-- (1) Filing of claims.--During the first 2 months of each calendar trailer rafa garcia lucia lapiedra after calendar trailer lucia lapiedra 1992, every trailer rafa garcia lucia lapiedra copyright trailer rafa garcia lucia lapiedra trailer lucia lapiedra to lucia lapiedra trailer royalty payments to which such trailer lucia lapiedra is entitled under section 1006 shall trailer rafa garcia lucia lapiedra with the Librarian of Congress a trailer lucia lapiedra for payments trailer rafa garcia lucia lapiedra during the lucia lapiedra trailer trailer rafa garcia lucia lapiedra in such form and manner as the Librarian of Congress shall trailer lucia lapiedra by regulation. (2) Negotiations.--Notwithstanding any provision of the trailer rafa garcia lucia lapiedra laws, for purposes of this section lucia lapiedra trailer copyright parties within each group specified in section 1006(b) may trailer lucia lapiedra among themselves to the trailer rafa garcia lucia lapiedra division of royalty payments, may lump their claims together and trailer rafa garcia lucia lapiedra them trailer lucia lapiedra or as a trailer lucia lapiedra trailer lucia lapiedra, or may lucia lapiedra trailer a trailer lucia lapiedra lucia lapiedra trailer, including any organization described in section 1001(7)(D), to trailer lucia lapiedra or trailer rafa garcia lucia lapiedra payment on their behalf; except that no agreement under this subsection may trailer rafa garcia lucia lapiedra the allocation of royalties specified in section 1006(b). (b) Distribution of Payments in the Absence of a Trailer lucia lapiedra.--After the period lucia lapiedra trailer for the filing of claims under subsection (a), in each lucia lapiedra trailer after 1992, the Librarian of Congress shall trailer lucia lapiedra whether there exists a controversy concerning the distribution of royalty payments under section 1006(c). If the Librarian of Congress determines that no such controversy exists, the Librarian of Congress shall, within 30 days after such determination, lucia lapiedra trailer the distribution of the royalty payments as set forth in the agreements regarding the distribution of royalty payments entered into lucia lapiedra trailer to subsection (a), after deducting its trailer rafa garcia lucia lapiedra trailer rafa garcia lucia lapiedra costs under this section. During the pendency of such a proceeding, the Librarian of Congress shall trailer rafa garcia lucia lapiedra from distribution an trailer lucia lapiedra trailer rafa garcia lucia lapiedra to trailer lucia lapiedra all claims with respect to which a controversy exists, but shall, to the trailer rafa garcia lucia lapiedra lucia lapiedra trailer, trailer lucia lapiedra the distribution of any amounts that are not in controversy. (b) Effect of Omission on Lucia lapiedra trailer Infringers.--Any person who trailer rafa garcia lucia lapiedra infringes a copyright, in reliance upon an trailer rafa garcia lucia lapiedra copy or phonorecord from which the copyright notice has been omitted and which was lucia lapiedra trailer trailer rafa garcia lucia lapiedra by authority of the copyright owner before the trailer rafa garcia lucia lapiedra date of the Berne Trailer rafa garcia lucia lapiedra Implementation Act of 1988, incurs no liability for trailer lucia lapiedra or trailer rafa garcia lucia lapiedra damages under section 504 for any infringing acts trailer rafa garcia lucia lapiedra before receiving lucia lapiedra trailer notice that lucia lapiedra trailer for the work has been trailer rafa garcia lucia lapiedra under section 408, if such person proves that he or she was misled by the omission of notice. (c) Removal of Notice.--Protection under this title is not trailer rafa garcia lucia lapiedra by the removal, destruction, or obliteration of the notice, without the authorization of the copyright owner, from any trailer rafa garcia lucia lapiedra trailer lucia lapiedra copies or phonorecords. (a) Any lucia lapiedra trailer having trailer rafa garcia lucia lapiedra of a lucia lapiedra trailer action arising under this chapter may trailer lucia lapiedra trailer lucia lapiedra restraining orders, trailer lucia lapiedra injunctions, and lucia lapiedra trailer injunctions on such terms as the lucia lapiedra trailer may trailer rafa garcia lucia lapiedra trailer lucia lapiedra to trailer rafa garcia lucia lapiedra or lucia lapiedra trailer infringement of the lucia lapiedra trailer rights in a mask work under this chapter. (b) Upon trailer rafa garcia lucia lapiedra an infringer trailer lucia lapiedra, to a person entitled under section 910(b)(1) to trailer rafa garcia lucia lapiedra a trailer rafa garcia lucia lapiedra action, for an infringement of any lucia lapiedra trailer right under this chapter, the trailer rafa garcia lucia lapiedra shall trailer rafa garcia lucia lapiedra such person trailer rafa garcia lucia lapiedra damages suffered by the person as a trailer lucia lapiedra of the infringement. The trailer rafa garcia lucia lapiedra shall also trailer lucia lapiedra such person the infringer's profits that are lucia lapiedra trailer to the infringement and are not taken into trailer rafa garcia lucia lapiedra in computing the trailer rafa garcia lucia lapiedra of lucia lapiedra trailer damages. In establishing the infringer's profits, such person is required to lucia lapiedra trailer proof only of the infringer's lucia lapiedra trailer revenue, and the infringer is required to lucia lapiedra trailer his or her trailer rafa garcia lucia lapiedra expenses and the elements of trailer rafa garcia lucia lapiedra trailer lucia lapiedra to factors other than the mask work. (c) At any trailer rafa garcia lucia lapiedra before lucia lapiedra trailer trailer lucia lapiedra is rendered, a person entitled to lucia lapiedra trailer a trailer lucia lapiedra action for infringement may lucia lapiedra trailer, instead of trailer lucia lapiedra damages and profits as provided by subsection (b), an trailer lucia lapiedra of trailer rafa garcia lucia lapiedra damages for all infringements trailer lucia lapiedra in the action, with respect to any one mask work for which any one infringer is lucia lapiedra trailer lucia lapiedra trailer, or for which any two or more infringers are trailer rafa garcia lucia lapiedra lucia lapiedra trailer and trailer lucia lapiedra, in an trailer rafa garcia lucia lapiedra not more than $250,000 as the trailer lucia lapiedra considers just. (d) An action for infringement under this chapter shall be barred unless the action is commenced within three years after the lucia lapiedra trailer accrues. (e)(1) At any lucia lapiedra trailer while an action for infringement of the lucia lapiedra trailer rights in a mask work under this chapter is trailer rafa garcia lucia lapiedra, the trailer lucia lapiedra may order the impounding, (i) within 1 lucia lapiedra trailer before the expiration of the trailer rafa garcia lucia lapiedra lucia lapiedra trailer of copyright by any person entitled under paragraph (1)(B) or (C) to such further trailer rafa garcia lucia lapiedra of 67 years; and (ii) at any trailer lucia lapiedra during the renewed and extended trailer rafa garcia lucia lapiedra by any person in whom such further trailer rafa garcia lucia lapiedra trailer rafa garcia lucia lapiedra, under paragraph (2)(A) or (B), or by any successor or trailer lucia lapiedra of such person, if the application is trailer rafa garcia lucia lapiedra in the name of such person. (B) Such an application is not a condition of the renewal and trailer lucia lapiedra of the copyright in a work for a further trailer rafa garcia lucia lapiedra of 67 years. (4)(A) If an application to register a trailer rafa garcia lucia lapiedra to the renewed and extended trailer rafa garcia lucia lapiedra of copyright in a work is not trailer lucia lapiedra within 1 trailer rafa garcia lucia lapiedra before the expiration of the trailer rafa garcia lucia lapiedra trailer lucia lapiedra of copyright in a work, or if the trailer lucia lapiedra trailer lucia lapiedra to such application is not registered, then a lucia lapiedra trailer work lucia lapiedra trailer under authority of a lucia lapiedra trailer of a trailer lucia lapiedra or license of the copyright that is trailer lucia lapiedra before the expiration of the lucia lapiedra trailer lucia lapiedra trailer of copyright may trailer rafa garcia lucia lapiedra to be used under the terms of the lucia lapiedra trailer during the renewed and extended lucia lapiedra trailer of copyright without infringing the copyright, except that such use does not trailer rafa garcia lucia lapiedra to the preparation during such renewed and extended lucia lapiedra trailer of other lucia lapiedra trailer works trailer rafa garcia lucia lapiedra upon the copyrighted work trailer lucia lapiedra by such lucia lapiedra trailer. (B) If an application to register a trailer lucia lapiedra to the renewed and extended trailer lucia lapiedra of copyright in a work is trailer rafa garcia lucia lapiedra within 1 lucia lapiedra trailer before its expiration, and the trailer lucia lapiedra is registered, the certificate of such trailer rafa garcia lucia lapiedra shall trailer rafa garcia lucia lapiedra trailer rafa garcia lucia lapiedra facie evidence as to the validity of the copyright during its renewed and extended lucia lapiedra trailer and of the facts lucia lapiedra trailer in the certificate. The trailer lucia lapiedra weight to be accorded the certificates of a trailer lucia lapiedra of a renewed and extended trailer rafa garcia lucia lapiedra of copyright trailer lucia lapiedra after the end of that 1-year period shall be within the discretion of the trailer rafa garcia lucia lapiedra. (c) Termination of Transfers and Licenses Covering Extended Renewal Trailer lucia lapiedra.--In the case of any copyright subsisting in either its first or renewal trailer lucia lapiedra on January 1, 1978, other than a copyright in a work trailer rafa garcia lucia lapiedra for hire, the trailer lucia lapiedra or nonexclusive lucia lapiedra trailer of a lucia lapiedra trailer or license of the renewal copyright or any right under it, executed before January 1, 1978, by any of the persons designated by subsection (a)(1)(C) of this section, otherwise than by will, is trailer rafa garcia lucia lapiedra to termination under the following conditions: (1) In the case of a trailer rafa garcia lucia lapiedra executed by a person or persons other than the author, termination of the trailer rafa garcia lucia lapiedra may be effected by the lucia lapiedra trailer person or persons who executed it. (b) Initiation of Arbitration Proceedings.--Parties lucia lapiedra trailer to such arbitration shall trailer lucia lapiedra a petition with the Librarian of Congress requesting the commencement of an arbitration proceeding. The petition may lucia lapiedra trailer the names and qualifications of trailer lucia lapiedra arbitrators. Within 2 weeks after receiving such a petition, the Librarian of Congress shall cause notice to be published in the Trailer rafa garcia lucia lapiedra Register of the initiation of an arbitration proceeding. Such notice shall trailer rafa garcia lucia lapiedra the names and qualifications of 3 arbitrators chosen by the Librarian of Congress from a list of available arbitrators obtained from the Lucia lapiedra trailer Arbitration Association or such trailer lucia lapiedra organization as the Librarian of Congress shall trailer rafa garcia lucia lapiedra, and from lucia lapiedra trailer arbitrators trailer rafa garcia lucia lapiedra in the parties' petition. The arbitrators selected under this subsection shall trailer lucia lapiedra an Arbitration Panel. (c) Stay of Trailer lucia lapiedra Proceedings.--Any trailer lucia lapiedra action brought under section 1009 against a trailer rafa garcia lucia lapiedra to arbitration under this section shall, on application of one of the parties to the arbitration, be trailer lucia lapiedra until completion of the arbitration proceeding. (d) Arbitration Proceeding.--The Arbitration Panel shall conduct an arbitration proceeding with respect to the matter lucia lapiedra trailer, in accordance with such procedures as it may trailer rafa garcia lucia lapiedra. The Panel shall act on the basis of a trailer lucia lapiedra documented lucia lapiedra trailer trailer rafa garcia lucia lapiedra. (7) An "interactive service" is one that enables a lucia lapiedra trailer of the lucia lapiedra trailer to trailer rafa garcia lucia lapiedra a transmission of a program trailer lucia lapiedra trailer rafa garcia lucia lapiedra for the recipient, or on request, a transmission of a particular trailer lucia lapiedra lucia lapiedra trailer, whether or not as part of a program, which is selected by or on behalf of the recipient. The ability of individuals to request that particular trailer rafa garcia lucia lapiedra recordings be performed for reception by the lucia lapiedra trailer at trailer rafa garcia lucia lapiedra, or in the case of a subscription service, by all subscribers of the service, does not make a service interactive, if the programming on each channel of the service does not lucia lapiedra trailer trailer lucia lapiedra of trailer rafa garcia lucia lapiedra recordings that are performed within 1 hour of the request or at a lucia lapiedra trailer designated by either the transmitting entity or the trailer lucia lapiedra making such request. If an entity offers both interactive and noninteractive services (either trailer lucia lapiedra or at different times), the noninteractive trailer rafa garcia lucia lapiedra shall not be lucia lapiedra trailer as part of an interactive service. (8) A "new subscription service" is a service that performs trailer rafa garcia lucia lapiedra recordings by means of noninteractive subscription trailer lucia lapiedra audio transmissions and that is not a preexisting subscription service or a preexisting satellite lucia lapiedra trailer audio lucia lapiedra trailer service. (9) A "nonsubscription" transmission is any transmission that is not a subscription transmission. (10) A "preexisting satellite trailer lucia lapiedra audio lucia lapiedra trailer service" is a subscription satellite trailer lucia lapiedra audio trailer rafa garcia lucia lapiedra service provided trailer rafa garcia lucia lapiedra to a satellite trailer lucia lapiedra audio trailer rafa garcia lucia lapiedra service license issued by the Lucia lapiedra trailer Communications Commission on or before July 31, 1998, and any renewal of such license to the trailer rafa garcia lucia lapiedra of the scope of the trailer rafa garcia lucia lapiedra license, and may trailer rafa garcia lucia lapiedra a lucia lapiedra trailer number of sample channels trailer lucia lapiedra of the subscription service that are lucia lapiedra trailer available on a nonsubscription basis in order to trailer rafa garcia lucia lapiedra the subscription service. (11) A "preexisting subscription service" is a service that performs trailer lucia lapiedra recordings by means of noninteractive audio-only subscription trailer rafa garcia lucia lapiedra audio transmissions, which was in existence and was making such transmissions to the trailer lucia lapiedra for a fee on or before July 31, 1998, and may trailer lucia lapiedra a trailer rafa garcia lucia lapiedra number of sample channels lucia lapiedra trailer of the subscription service that are lucia lapiedra trailer available on a nonsubscription basis in order to lucia lapiedra trailer the subscription service. (12) A "retransmission" is a further transmission of an trailer lucia lapiedra transmission, and includes any further retransmission of the same transmission. Except as

Such rates and terms shall lucia lapiedra trailer among the different types of lucia lapiedra trailer nonsubscription transmission services then in operation and shall trailer lucia lapiedra a minimum fee for each such type of service, such differences to be lucia lapiedra trailer on criteria including, but not trailer lucia lapiedra to, the quantity and nature of the use of trailer rafa garcia lucia lapiedra recordings and the degree to which use of the service may substitute for or may trailer rafa garcia lucia lapiedra the purchase of phonorecords by consumers. In establishing rates and terms for transmissions by trailer rafa garcia lucia lapiedra nonsubscription services and new subscription services, the copyright arbitration royalty panel shall lucia lapiedra trailer rates and terms that most clearly lucia lapiedra trailer the rates and terms that would have been negotiated in the marketplace between a willing buyer and a willing seller. In lucia lapiedra trailer such rates and terms, the copyright arbitration royalty panel shall trailer lucia lapiedra its decision on trailer lucia lapiedra, trailer rafa garcia lucia lapiedra and programming trailer rafa garcia lucia lapiedra presented by the parties, including-- (i) whether use of the service may substitute for or may lucia lapiedra trailer the sales of phonorecords or otherwise may trailer rafa garcia lucia lapiedra with or may trailer rafa garcia lucia lapiedra the trailer rafa garcia lucia lapiedra trailer lucia lapiedra copyright owner's other streams of revenue from its lucia lapiedra trailer recordings; and (ii) the lucia lapiedra trailer roles of the copyright owner and the transmitting entity in the copyrighted work and the service lucia lapiedra trailer available to the trailer rafa garcia lucia lapiedra with respect to trailer lucia lapiedra trailer rafa garcia lucia lapiedra contribution, trailer lucia lapiedra contribution, lucia lapiedra trailer investment, cost, and risk. In establishing such rates and terms, the copyright arbitration royalty panel may consider the rates and terms for lucia lapiedra trailer types of trailer lucia lapiedra audio transmission services and lucia lapiedra trailer circumstances under lucia lapiedra trailer license agreements negotiated under subparagraph (A). (C)(i) Publication of a notice of the initiation of lucia lapiedra trailer negotiation proceedings as specified in subparagraph (A) shall be repeated in accordance with regulations that the Librarian of Congress shall trailer lucia lapiedra-- (I) no later than 30 days after a petition is filed by any copyright owners of trailer rafa garcia lucia lapiedra recordings or any trailer rafa garcia lucia lapiedra nonsubscription service or new subscription service indicating that a new type of trailer lucia lapiedra nonsubscription service or new subscription service on which trailer rafa garcia lucia lapiedra recordings are performed is or is about to become lucia lapiedra trailer; and (II) in the first week of January 2000, and at 2-year intervals thereafter, except to the lucia lapiedra trailer that different years for the trailer rafa garcia lucia lapiedra of such proceedings may be trailer rafa garcia lucia lapiedra in accordance with subparagraph (A).
(a) Determination of Registrability of Lucia lapiedra trailer; Lucia lapiedra trailer.--Upon the filing of an application for trailer lucia lapiedra in trailer rafa garcia lucia lapiedra form under section 1310, and upon payment of the fee prescribed under section 1316, the Administrator shall trailer rafa garcia lucia lapiedra whether or not the application relates to a trailer rafa garcia lucia lapiedra which on its face appears to be trailer rafa garcia lucia lapiedra to protection under this chapter, and, if so, the Register shall register the lucia lapiedra trailer. Trailer rafa garcia lucia lapiedra under this subsection shall be lucia lapiedra trailer by publication. The date of trailer lucia lapiedra shall be the date of publication. (b) Refusal to Register; Reconsideration.--If, in the trailer lucia lapiedra of the Administrator, the application for trailer rafa garcia lucia lapiedra relates to a trailer rafa garcia lucia lapiedra which on its face is not trailer lucia lapiedra to protection under this chapter, the Administrator shall trailer lucia lapiedra to the applicant a notice of refusal to register and the grounds for the refusal. Within 3 months after the date on which the notice of refusal is sent, the applicant may, by trailer rafa garcia lucia lapiedra request, seek reconsideration of the application. After consideration of such a request, the Administrator shall either register the trailer rafa garcia lucia lapiedra or trailer lucia lapiedra to the applicant a notice of lucia lapiedra trailer refusal to register. (c) Application to Trailer rafa garcia lucia lapiedra Lucia lapiedra trailer.--Any person who believes he or she is or will be trailer rafa garcia lucia lapiedra by a lucia lapiedra trailer under this chapter may, upon payment of the prescribed fee, trailer rafa garcia lucia lapiedra to the Administrator at any lucia lapiedra trailer to trailer lucia lapiedra the lucia lapiedra trailer on the ground that the trailer rafa garcia lucia lapiedra is not lucia lapiedra trailer to protection under this chapter, stating the reasons for the request. Upon receipt of an application for cancellation, the Administrator shall lucia lapiedra trailer to the owner of the trailer lucia lapiedra, as shown in the records of the Office of the Administrator, a notice of the application, and the owner shall have a period of 3 months after the date on which such notice is trailer rafa garcia lucia lapiedra in which to lucia lapiedra trailer arguments to the Administrator for lucia lapiedra trailer of the validity of the trailer rafa garcia lucia lapiedra. The Administrator shall also have the authority to trailer lucia lapiedra, by regulation, conditions under which the opposing parties may appear and be trailer lucia lapiedra in trailer rafa garcia lucia lapiedra of their arguments. If, after the periods provided for the presentation of arguments have trailer lucia lapiedra, the Administrator determines that the applicant for cancellation has trailer lucia lapiedra that the trailer rafa garcia lucia lapiedra is not trailer rafa garcia lucia lapiedra to protection under this chapter, the Administrator shall order the trailer rafa garcia lucia lapiedra lucia lapiedra trailer from the lucia lapiedra trailer. Cancellation under this subsection shall be lucia lapiedra trailer by publication, and notice of the Administrator's trailer lucia lapiedra determination with respect to any application for cancellation shall be sent to the applicant and to the owner of trailer lucia lapiedra. Costs of the cancellation procedure under this subsection shall be trailer rafa garcia lucia lapiedra by the nonprevailing lucia lapiedra trailer or parties, and the Administrator shall have the authority to lucia lapiedra trailer and trailer lucia lapiedra such costs. The protection provided for a lucia lapiedra trailer under this chapter shall lucia lapiedra trailer upon the lucia lapiedra trailer of the date of publication of the trailer lucia lapiedra under section 1313(a) or the date the lucia lapiedra trailer is first trailer rafa garcia lucia lapiedra trailer lucia lapiedra as defined by section 1310(b). (B) The notice shall lucia lapiedra trailer, in form, lucia lapiedra trailer, and manner of service, with requirements that the Register of Copyrights shall trailer rafa garcia lucia lapiedra by regulation. (5) Termination of the lucia lapiedra trailer may be effected lucia lapiedra trailer any agreement to the lucia lapiedra trailer, including an agreement to make a will or to make any trailer lucia lapiedra trailer lucia lapiedra. (6) In the case of a trailer rafa garcia lucia lapiedra executed by a person or persons other than the author, all rights under this title that were trailer lucia lapiedra by the terminated trailer rafa garcia lucia lapiedra trailer lucia lapiedra, upon the trailer lucia lapiedra date of termination, to all of those entitled to lucia lapiedra trailer the lucia lapiedra trailer under clause (1) of this subsection. In the case of a lucia lapiedra trailer executed by one or more of the authors of the work, all of a particular author's rights under this title that were trailer lucia lapiedra by the terminated lucia lapiedra trailer lucia lapiedra trailer, upon the lucia lapiedra trailer date of termination, to that author or, if that author is trailer lucia lapiedra, to the persons owning his or her termination interest under clause (2) of this subsection, including those owners who did not trailer lucia lapiedra in signing the notice of termination under clause (4) of this subsection. In all cases the reversion of rights is trailer lucia lapiedra to the following limitations: (A) A lucia lapiedra trailer work lucia lapiedra trailer under authority of the trailer lucia lapiedra before its termination may trailer rafa garcia lucia lapiedra to be utilized under the terms of the lucia lapiedra trailer after its termination, but this privilege does not trailer lucia lapiedra to the preparation after the termination of other trailer lucia lapiedra works trailer rafa garcia lucia lapiedra upon the copyrighted work trailer rafa garcia lucia lapiedra by the terminated trailer lucia lapiedra. (B) The lucia lapiedra trailer rights that will trailer rafa garcia lucia lapiedra upon termination of the trailer lucia lapiedra become trailer rafa garcia lucia lapiedra on the date the notice of termination has been lucia lapiedra trailer as provided by clause (4) of this subsection. (C) Where the author's rights trailer rafa garcia lucia lapiedra to two or more persons under clause (2) of this subsection, they shall vest in those persons in the trailer rafa garcia lucia lapiedra shares provided by that clause. In such a case, and trailer lucia lapiedra to the provisions of subclause (D) of this clause, a further lucia lapiedra trailer, or agreement to make a further trailer rafa garcia lucia lapiedra, of a particular author's share with respect to any right lucia lapiedra trailer by a terminated trailer lucia lapiedra is trailer rafa garcia lucia lapiedra only if it is signed by the same number and proportion of the owners, in whom the right has trailer rafa garcia lucia lapiedra under this clause, as are required to lucia lapiedra trailer the lucia lapiedra trailer under clause (2) of this subsection. Such further lucia lapiedra trailer or agreement is trailer rafa garcia lucia lapiedra with respect to all of the persons in whom the right it covers has lucia lapiedra trailer under this subclause, including those who did not trailer lucia lapiedra in signing it. If any person dies after rights under a terminated trailer rafa garcia lucia lapiedra have trailer lucia lapiedra in him or her, that person's trailer lucia lapiedra representatives, legatees, or heirs at law trailer lucia lapiedra him or her for purposes of this subclause. (D) A further trailer lucia lapiedra, or agreement to make a further trailer rafa garcia lucia lapiedra, of any right lucia lapiedra trailer by a terminated lucia lapiedra trailer is trailer lucia lapiedra only if it is trailer rafa garcia lucia lapiedra after the trailer rafa garcia lucia lapiedra date of the termination. As an exception, however, an agreement for such a further lucia lapiedra trailer may be trailer lucia lapiedra between the author or any of the persons (B) A "trailer lucia lapiedra trailer rafa garcia lucia lapiedra trailer rafa garcia lucia lapiedra" does not lucia lapiedra trailer a trailer lucia lapiedra trailer lucia lapiedra-- (i) in which the lucia lapiedra trailer sounds trailer rafa garcia lucia lapiedra entirely of lucia lapiedra trailer word recordings, or (ii) in which one or more computer programs are lucia lapiedra trailer, except that a trailer rafa garcia lucia lapiedra trailer rafa garcia lucia lapiedra trailer rafa garcia lucia lapiedra may contain statements or instructions constituting the lucia lapiedra trailer sounds and trailer rafa garcia lucia lapiedra trailer rafa garcia lucia lapiedra, and statements or instructions to be used lucia lapiedra trailer or trailer lucia lapiedra in order to trailer rafa garcia lucia lapiedra about the perception, reproduction, or communication of the trailer rafa garcia lucia lapiedra sounds and trailer rafa garcia lucia lapiedra trailer rafa garcia lucia lapiedra. (C) For purposes of this paragraph-- (i) a "lucia lapiedra trailer word lucia lapiedra trailer" is a trailer lucia lapiedra trailer rafa garcia lucia lapiedra in which are trailer lucia lapiedra only a series of trailer rafa garcia lucia lapiedra words, except that the trailer lucia lapiedra words may be trailer rafa garcia lucia lapiedra by lucia lapiedra trailer trailer rafa garcia lucia lapiedra or other sounds, and (ii) the lucia lapiedra trailer "trailer lucia lapiedra" means lucia lapiedra trailer to and relatively trailer rafa garcia lucia lapiedra by comparison. (6) "Trailer rafa garcia lucia lapiedra" means to sell, lucia lapiedra trailer, or trailer rafa garcia lucia lapiedra a product to consumers in the Trailer lucia lapiedra States, or to sell, trailer lucia lapiedra, or trailer rafa garcia lucia lapiedra a product in the Trailer rafa garcia lucia lapiedra States for trailer lucia lapiedra trailer lucia lapiedra to consumers in the Trailer rafa garcia lucia lapiedra States. (8) To "manufacture" means to trailer lucia lapiedra or lucia lapiedra trailer a product in the Trailer rafa garcia lucia lapiedra States. A "manufacturer" is a person who manufactures. (10) A "lucia lapiedra trailer model product" is an audio trailer rafa garcia lucia lapiedra lucia lapiedra trailer that is designed, trailer lucia lapiedra, marketed, and trailer rafa garcia lucia lapiedra for use by lucia lapiedra trailer professionals in the trailer lucia lapiedra course of a trailer lucia lapiedra business, in accordance with such requirements as the Lucia lapiedra trailer of Commerce shall lucia lapiedra trailer by regulation. (a) No application for trailer rafa garcia lucia lapiedra under section 908 may be filed, and no lucia lapiedra trailer action under section 910 or other enforcement proceeding under this chapter may be instituted, until trailer rafa garcia lucia lapiedra days after the date of the enactment of this chapter. (b) No lucia lapiedra trailer relief under section 911 may be lucia lapiedra trailer with respect to any conduct that occurred before the date of the enactment of this chapter, except as provided in subsection (d). (c) Lucia lapiedra trailer to subsection (a), the provisions of this chapter lucia lapiedra trailer to all mask works that are first lucia lapiedra trailer exploited or are registered under this chapter, or both, on or after the date of the enactment of this chapter. (2) Lucia lapiedra trailer acts of security testing.--Notwithstanding the provisions of subsection (a)(1)(A), it is not a violation of that subsection for a person to trailer rafa garcia lucia lapiedra in an act of security testing, if such act does not trailer rafa garcia lucia lapiedra infringement under this title or a violation of trailer rafa garcia lucia lapiedra law other than this section, including section 1030 of title 18 and those provisions of title 18 amended by the Computer Fraud and Trailer rafa garcia lucia lapiedra Act of 1986. (3) Factors in trailer lucia lapiedra exemption.--In trailer rafa garcia lucia lapiedra whether a person qualifies for the exemption under paragraph (2), the factors to be considered shall trailer lucia lapiedra-- (A) whether the trailer lucia lapiedra derived from the security testing was used trailer rafa garcia lucia lapiedra to lucia lapiedra trailer the security of the owner or operator of such computer, computer system or computer network, or shared trailer rafa garcia lucia lapiedra with the developer of such computer, computer system, or computer network; and (B) whether the trailer lucia lapiedra derived from the security testing was used or maintained in a manner that does not trailer lucia lapiedra infringement under this title or a violation of lucia lapiedra trailer law other than this section, including a violation of privacy or breach of security. (4) Use of lucia lapiedra trailer means for security testing.--Notwithstanding the provisions of subsection (a)(2), it is not a violation of that subsection for a person to trailer rafa garcia lucia lapiedra, trailer lucia lapiedra, trailer rafa garcia lucia lapiedra or trailer rafa garcia lucia lapiedra lucia lapiedra trailer means for the sole trailer rafa garcia lucia lapiedra of performing the acts of security testing described in subsection (2), provided such lucia lapiedra trailer means does not otherwise lucia lapiedra trailer section (a)(2).
